[Music] okay you're on good evening this is the Planning and Zoning Commission meeting it's June 23rd and it's 6:00 p.m. our first item is conflict of interest does anybody have a conflict of interest with the items on the agenda tonight if you do raise your hand otherwise I don't see any hands being raised so okay no conflict of interest next is the approval of minutes need a motion to approve the minutes I make a motion to approve the minutes second circuit thank you okay it's been moved and seconded that we approve the minutes any comments on the minutes okay all those in favor just raise your hand like this okay Garden Harvey got Commissioner Gordon to eurasia are you approving the minutes raise your hand okay the minutes have been approved okay the next items are the next item is postponements we don't have any of those and then we're going to up to public participation and I think sarah has something to say here and yes this is Sara Gonzales with the Community Development Department and we would like to ask that we say he unfortunately goodbye to rest Smith unrest has actually turned in his resignation from the actual Planning and Zoning Commission board and Larry Nichols does have some stuff to provide to just show our appreciation for all the work and the effort that russ has put in the commission during the two years that he was on the board and so I will turn it over to director Nichols Thank You Sara madam chairman and members of the Commission Larry Nichols director of community development for the record I just want to follow up with what Sara began to say where we're all saddened to say that Russ is going to turn his resignation from the board because he was the often voice of reason on many of the cases and he served the the Commission in an exemplary manner and we can't appreciate him enough so we we wanted to do a few little things here to recognize Russ for his some is two years of service on the on the Commission in so I have here and hope it can show up I'm gonna try to position it so he can show up and I'll read this into the record it's a certificate of appreciation this acknowledges that Russ Smith planning a zoning Commissioner 2018 to 2020 has provided invaluable guidance as a member of the Las Cruces Planning and Zoning Commission your contribution analysis and visionary decisions on land use has improved the city of Las Cruces community on behalf of the city of Las Cruces and the citizenry of Las Cruces our gratitude and sincere appreciation Russ for your service on the Commission but hold on folks that's not all we also are have for us we're going to have a a fashionable elevate Las Cruces comprehensive plan baseball hat that we hope you will wear with pride and a elevate Las Cruces travel mug for your favorite coffee or favorite drink and so when you're traveling you can take it with you and lastly we like here in the Community Development Department whenever someone travels and goes on to their next end ever we'd like to do a caricature for that person to take with them as the memento from the department so Russ we have done that for you and I don't know if you can see that clearly but we'll do a little bit like that but it's a character caricature of Russ he's sitting at the at the panel at the dais and he has up here at the top it says elevate up and up and then over here it says move to approve and Russ has got his hand up like this and he has a smile on his face because he's known he's taken an appropriate action for a case that was before him so Russ we have all of these for you here in the office and when you get a chance to drop by we we hope that you'll do that and we'll very happily share these with you but last comment mr. mandamus chairman and members of the Commission I know you'll join me in saying that Thank You Russ we appreciate the time that you spent and your planning of Zoning Commission service to the city it was very much appreciated thank you thank you mr. Nichols and and I want to add that I'm really sad to see Russ leave as mr. Nichols pointed out us often have asked the very astute questions and and you played a very large role in the elevate las cruces work so we wish you best in whatever you're moving on to and hope that we haven't seen the last of you you said you'd be available for particular level tasks or whenever we might need to call on you so we definitely will do that and we just want to say thank you many times over I think I will take a brief moment to respond this is kind of surprising me this is uh catching me off guard Sara and Larry with your ingenuity here yeah I'll pick up the hat and the cup and the caricature those mementos I don't think I risk that I'd have to stand to the side and sign any my lars at the time so I think that's risk free to all of you here that I've shared the diet's with to all of you that I've shared moments of concern and moments of fun and progress it's been a great experience my focus now goes into more of a commercial driving dedication I have to cope it has slow day it was a Cova day and and we all want that to change and adjust and mature it is something as we all know it can be and should be we know what life in the in the fast lane looks like and I think we want it again thank you so much okay our next item is the consent agenda we don't have anything on the consent agenda and we don't have any old business so we're going to move along to the new business last question before you start with the cases is it necessary for us to redo the we organized the agenda but they're going to hear these two cases as one for the agenda show them separately yes we're going to hear them together but vote arms separately we don't have to reorder the agenda we don't have to reorganize it but I think we will not do a motion we'll just have the presentation and all that information and then we'll do two motions separately so it okay with everybody okay good start with Sara you're doing the presentations all right yes so I'll go ahead and share my screen with everybody as far as the presentation let me know if everybody can see the screen okay and so this is a proposed master plan and preliminary plat for Lennox north subdivision currently the property is located between Seneca Drive and i-25 highway and where it connects to Lennox Avenue and mohegan trail property encompasses twenty point six one three acres in size and it currently has three zoning designations upon them so there's our 1a which is single-family medium density we have our one AC which is single family medium that's a conditional the condition placed on the property back in 2000 was to have utilities placed underground as part of the development that will be a requirement for the entire subdivision so that condition will be met and lastly there is FC which is our flood control because the property is designated within a flood control Arroyo area property is currently vacant and undeveloped and previously there was a master plan implement a plan approved in 2006 due to the recession at the time that a property was not developed and it does expire after five years which makes the applicant have to come back in for the the process again to redo here's an sony map of the subject property as you can see highlighted the flood control area is designated in blue which is located on the north portion of one of the parcels it then goes into the Arwen a scene where basically the utilities are placed underground for the condition and then you have our 1a as the remaining portion of the property essentially the entire property is designated in order to develop for single-family residential homes the surrounding area as you can see is all designated as Arwen a single-family residential until you get over to Elks which is located on the west side of the property where you have some are for some commercial and then some of the r3 which is where the Moose Lodge is located here's an aerial map of the subject property as you can tell the property is stones that have one point of access out so they're not actually connecting there's not any connections in order for her safety were on Linux and you wanted to get out of Mohegan you currently couldn't do that with what the applicant is proposing they're proposing to subdivide the two existing parcels into 92 single-family residential lots there's also going to be 8 tracks that will be designated for drainage and utilities and then it will be constructed within three phases after this process has started the applicant did decide that they were probably going to develop it all into one phase and so they still have that opportunity the right-of-way will help to connect the two existing subdivisions by having Lennox go through to the north side and connecting to Mohican trail from the subdivision process the application has matched all of the subdivision code the design standards for the right away and the zoning code as far as the Arwen a standards of meaning the minimum lot sizes in the minimum densities it also does follow our active transportation plan by now providing connection through these two subdivision and it's also supported by elevate which designates this area as a suburban place type and increase in density for residential here are some smaller shots of basically showing the design of the property and this is first the master plan as proposed at first it was going to be basically the stream of lots along Seneca Drive those Lots were going to be built out in phase one then you would have the remaining lots that are gonna be located on the east side where the coldest acts were that was going to be phase two and then you would have phase three here for the last ten remove Lots as you can see from the south side this would be Lenox connecting in and then they would be able to drive through to the north and end up basically on Mohican trail lunar plat is very similar to a master plan master plan process is required in order to develop land in either phases or if there are more Lots exceeding the number of 40 so in this case there is 92 proposed Lots they were going to do three phases and that's why the master plan was required at the same time the applicant submitted the master plan in the preliminary plat in order to go through the process simultaneously so we could actually see the layout as staff did send this review out to all the relevant agencies and departments which did support the proposed master plan and preliminary plat one of the comments that we did receive from fire is that they do support the subdivision in order to improve response times within that area currently with only having the one access point through Lennox subdivision it can create some issues or caution as far as that Elks turn and getting into these subdivisions and being able to get out this will provide them a second option we did also send notice to the surrounding property owners and we did receive at this point we've received three in emails and six phone calls that were not in support and then two phone calls that were in support as far as the three emails I will read into the record essentially some of the concerns and then address those concerns as how they will be taking place as part of the construction phase my name is Sam Aeneas I live at 2012 16 Edgewood which connects to Seneca Drive but the subdivision being built east of Seneca Drive this would increase the traffic on Edgewood which would now which is now a speedway for all that live on Seneca and connecting streets is the limit on an twitter's 25 miles which is rarely enforced I think the subdivision to be developed if the subdivision is developed a speed bump or two or three more bumps would help control the speeds along Edgewood that is currently being used on Jasmine Drive so please consider this as a suggestion um I am sure the residents on edge would be in favor for this our next email comes from Julie Barton indicating that elq's is already way too congested and adding 93 dwellings as kin is going to cause more traffic nightmare and live on Edgewood and we have a ton of people who speed down our nice wide streets and the new addition will add to the traffic that our streets on Oakes already access people love to travel down Seneca and then down Edgewood to get to Elks we have had people last week drive 50 miles of our street please do not have more vehicles to the traffic or streets and more traffic to congest Elks it poses a huge issue if there's an emergency and we had to evacuate the area our last email came in from Tracy Mikko cell I live on a North Ridge Drive I'm also a teacher and another teacher who works for Animus Union and you have a on a grant with sustainable farming and career opportunities for arid regions we do not have enough water for these subdivisions going up is there a study or council member looking at our resources why are there big pecan farms being able to add more and more countries which will are 100 to 200 gallons of water a day for Less harvest I think there is a big disconnect with what resources we have and how we are using them there's no water in our busca but there are now new pecan trees being planted next door and they will drain their water my second concern is personal and the traffic on the school days make it very difficult to turn left to get on elq's with the amount of traffic already and you are suggesting to add more houses to an area very little outside access both of these concerns address our resources and our air quality things that everyone needs to be concerned about we need to be concerned about the overall impact has there been a tomorrow environmental impact study done it may not be required but it is needed there does seem to be a disconnect on how we have sources available to us and what is being permitted in our city as far as their remaining phone calls that I did receive several were concerns because they did purchase their properties where Realtors told them that nobody would be developing behind their homes they were also asking questions essentially about the property values and if their property values were gonna go down based on the properties being developed and if there was basically increase in traffic how is it going to be mitigated the two phone calls that we did receive and support are encouraging the development in order to provide that second access point they would like to see the connection being done between the two developments as part of the process on when we did receive the public input I reached out to traffic traffic does to review the development within the areas as we get master plans implementing plans they did encourage that there is going to be a traffic impact analysis done at the time that the subdivision is submitted for construction drawings that will show us essentially what's taking place what's being done on the properties and how the sites will run if there are any traffic control measures that are deemed by traffic necessary then the developer will have to place those within the subdivision and then possibly within the surrounding subdivisions because of the increase in traffic currently there the response times for fire department is less and so they would like to increase their response times and be able to get there so we do see this as being a positive moving forward to our subdivisions another thing to keep in mind as far as the subdivision itself property has already been zoned prior to 1970 it was owned Darwin a at that point in time with that being the subdivision as long as it meets our codes following our when a standards meets design standards meets the developments of those Lots the property owner has the right to basically develop his land so with that we took the development the design to the design review committee on June 10th after we discussed some of the infrastructure the requirements having the traffic impact analysis at the time of construction staff did come to a recommendation of approval for the master plan and the preliminary plan the reasons based on the approval are that it does meet all the requirements for a master plan it does meet the requirements for a preliminary plat it is following the Arwen a zoning designation it also is following our act of transportation by providing connectivity between two existing subdivisions that are very limited on access points there's also meeting elevate by creating the suburban placetype which does increase in density within the area of saying between 15 to 30 dwelling units per acre and the DRC did recommend approval of the plan so with that I leave you with your options today with yes to approve vote no to deny reminder that if you do vote to deny staffs recommendation is in the affirmative so you would have to provide new facts of findings but yes with conditions our vote to table and that concludes my presentation thank you Sarah can you respond to the about the water it's my understanding that most of the water use in this areas comes from the agriculture around percent so madam chair with at least the water as part of utilities review they are regulating if we have the demand or if there's going to be enough capacity at these subdivisions coming in and so with that portion there was a study that was done previously showing that there is a 40-year out from where the city's water is capable of providing services so there has been at least studies that are posted on our website showing that as these as we continue to grow we do have sufficient amount of water to continue as part of that review I think utilities well you know indicate if we ever get to a point where we can no longer provide those services for subdivisions and we have to cut back there's gonna have to be some kind of public notice to property owners there would have to be some kind of disclosure I'm sure as we get to those close as we get closer to if we run out of water okay and the construction dog that will come to find Enzo anybody know and we can talk about the traffic impact madam chair they actually won't know shim plans and final plats are only through the development process so once the plumeria plan is completed then it will go through or if this evening then the applicant will submit final planning construction drawings at the same time a lot of times what happens is we see the preliminary plat but they have the option to sometimes reduce the number of watts they were to go forward they could actually reduce it which may change their traffic impact analysis and so we don't ask for the traffic impact analysis at this phase you're asking and now a construction phase because also in this case they weaned us for a traffic impact analysis in 2005 and use that one the scenarios are very different and so we have to look at the traffic at the time that they're actually submitting those construction drawings otherwise that it that information could be outdated okay and that's the southern what's the name of the street again that comes from the south that's madam sure that would be Lenox Avenue that connects so if that intersection becomes really overburdened in the future can that be looked at at some time I believe that traffic is already working on that intersection as far as the current standards now I know that there has been some barriers put up along elq's I know that there has been some traffic measures already taking place so that when people can't cross as easy this will help to provide and direct traffic into a little bit easier of a place so if you're on linux and you can see that it's backed up you now have a second option to go up to Mohegan Trowell to get out provides a little bit further down there is still that hill that's up by Mohegan Trell which is basically a horn out of school the middle school but it still does provide that option of you have a different way out and you're not trapped just this one exit there's another exit that's located near I believe it's now icebox brewery there's like a small street to get to Maine but it doesn't make for an easy turn to get up onto i-25 so a lot of people will go down elq's in order to get there so that's why linux become so congested so this will help hopefully with that intersection being congested and then as part of the traffic impact analysis yes that is something they're gonna review what's the current standards what's really happening and then what's going to add to it based on this development coming forward thank you comments or questions from other commissioners anybody raising their hand I think my biggest thing was sorry dude it's true Bennet yeah that Commissioner Bennet yeah I think my biggest thing was addressing that at speed area but it sounds like the city is already working on that so so I'm good any other comments or questions Commissioner Sanchez yeah just real quickly I'm just a comment yeah it appears to me as though by the time this gets to us it's pretty cut and dry I must say that when it appears to us oh and yet there are some very legitimate concerns about water and traffic and so in case anyone is watching those are watching this meeting and wanted here how we might address that I do believe those are things that need to be taken up in other forums of city government and I'd encourage them to do that as well of myself and also with traffic I would just encourage them to reach out to local law enforcement as well because they're also able to address those kinds of things to do different monitoring and stuff like that so I did want to just mention that in acknowledgment of those concerns even though I do see that those concerns are already addressed sufficiently by the time they get to us Beansie yeah yeah I just wanted to add to that because this is kind of like it's kind of like the same piece that we had last month where you know there was a lot of public comment done in through email and phone and that was great but you know after that I really got into thinking it's like you know kind of same thing Abraham said it's like you know like we're presented with a packet that you know has the information doesn't already been decided and I know sometimes it may seem unfair to people or that their voices aren't heard you do it we're not ready to have your voice heard I'm pretty familiar with that area I mean I've driven up there or coming around there many times I actually think like driving through Elks in just in general like that whole area the traffic needs to be revised because there's a lot of people that live out there and there's not a lot of exits so but yeah I just wanted to just throw that in there you know I mean I'm hopefully we can you know come up to a good solution and as we continue to push forward with elevate las cruces you know traffic should be definitely considered especially for some of these older parts of town that obviously there's been a lot of development a lot of stuff has changed in those areas thank you well I'm really hopeful that elevate Las Cruces when we get some of the codes change that we won't have this problem so much in the future currently we we tend to put a whole lot of subdivisions at all the traffic goes into one Street and that causes a big problem so we need much better connectivity and I hope going forward we have that but in the meantime people out there in the community you know you need to push for for if the particular intersection needs to be studied or and we don't the city doesn't do speed bumps I don't think much anymore because the public safety people don't like to be slowed down by those but there are other ways to slow traffic down and so talk to your counselor and get your voice heard that way and make sure the more the more we have this information the more people put forth their ideas and their thoughts the more we have the possibility of making changes going forward and I think the city is pretty well aware of these problems and we're trying to address them right now through elevate Las Cruces but you need to keep working on all of these problems anybody else madam chair this is raise my hand is a good time to speak go ahead okay thank you madam chair and the members of Commission I just wanted to offer I guess point of information perhaps or maybe just say a comment it was mentioned a few moments ago that by the time he gets to the Planning and Zoning Commission these cases are pretty much cut and dried and we don't really mean of course we don't view it that way we know that the decision lies with the plenty of Zoning Commission and then some and some of our cases they go on to the City Council but what we do know is this that we do prepare the cases for you well you know these proposals and some middles go through seven or eight of the city agencies utilities Public Works Community Development Parks and Rec that they all look at this and they provide the compliance for to meet our codes and our regulations and and sometimes our of course our rules but I just wanted to mention that that you know it's not a it's not an effort on the staffs part to say this is all cut and right the effort is to provide you with information that you can make a determination with having known have you known that it has gone through these various agencies to meet what the city sees has come thank you madam chairman Thank You mr. Nichols and just for the public to know we do get the report from the PRC so we do see what different departments say and there are things negotiated in many times so it doesn't just arrive without any kind of scrutiny and and we do have access to that scrutiny uh-huh Commissioner Gordon I didn't have a question I think it was said by Sarah that they do to be determined that if we will happen to be another perfect impact analysis that could be determined coming out I went over there and there's a limit amount of housing there and look not too many reasons you know there's a lot of Culver I can play dance and you could get lost in there but the thing is we did see terminal probably I would think that the best way to come out of here was unbelievable that's how I finally found the best way to get over to the property meheecan we'll probably I think firstly will requirement traffic people now what the traffic impact analysis will be determined that that would be a requirement to be able people to get out in Donata else you don't hear the phone making responsibility of installing that because I know it's quite expensive is the developer appeared if that happens to do that it was just going to become a city responsibility and they determined after the fact there should be some kind of traffic control for that Sarah or Commissioner Gordon Sara Gonzales for the record basically what would happen we would look at the expecting traffic and the existing impact that it would have and then work with the developer on the same process so it may be something that becomes multiple parties are involved because existing traffic that the developer did not participate with it so we would have to look at what's exactly happening now at the current state and the current homes see what's gonna happen with the new development and then they would determine how that would be basically rationed out so maybe part of a city project as well as working with the developer on the cost I do not have that information you know directly or no for sure and once they've determined because it may not be now where it may be in the future so what's the traffic impact analysis is determined what steps we have to take then it determines on which parties the developer is developing their 92 Lots what impact are they creating on the neighborhood but what's the impact of the existing neighborhood is really what we have to look at also so it could become a joint parties that we're gonna have to participating in this possible at this time to perhaps put a condition on is that if they become business or in the future that some kind of a chingoo or control device it was this area I think community that the developer will have to be a possibility and the course [Music] no I believe I heard you say your question was the developer know that they would have to be a part of it yes what I'm saying is that we can we put a condition on this now if determined in the future that there will be some kind of traffic control device will have lights that the developer will have a the course and not the city or even share with the soup now Michener's work this point in time we cannot put that condition based on the property because we don't know but the destination is going to be from the traffic impact analysis yes and also a fake lights a commissioner garden require certain number of federally determined forget what they're called but it's sort of out of our hands actually because it's a federal jurisdiction in terms of what requires what it has in order to put in a traffic light so that that's in the future and comes under some other jurisdiction right and man I'm sure that's correct we would essentially do the review through the traffic department and then there's an agreement based on public works and so it just depends on what's actually going to be proposed on the site they actually they're engineer is actually available on zoom' and may be able to answer any questions if I haven't been able to elaborate gentleman's name is Dan Lilly dan do you have anything else to add maybe to the comments for the traffic portion hi this is Dan Lilly I I don't have other than the fact that there there's there's been several developments in the area in the last you know 10 years or so and we're basically the last piece of property that can be even developed in this little stretch before the Sand Hill Royal and we will work closely with the traffic department to within mr. Travis and and determine if there are any mitigations we can do to help alleviate the existing traffic conditions at Elks that those the city is aware the state is aware of the the problem at Main Street next and that's that's going to be an ongoing situation whether we do it whether we do this development or not there's there's an issue there already so we're gonna try to do what we can to help mitigate traffic may be giving traffic another way to get out as mr. Garrow Oh perfect I wasn't sure if you can see me raising my hand um no I just actually wanted to take a moment and just thank the staff the city staff just in general just because you know you guys have really adapted to the situation I know hasn't been easy as we were joking before getting started technical difficulties always seem to happen but it is really great that you know you guys have made it work also to the public and members watching this like I know for some people it hasn't been ideal you know we haven't been able to have people actually come to the meetings it's not like somebody's gonna you know show up at our houses or whatever wherever we are at but you know hopefully you know as things sort of maybe start coming back to normal maybe you know we can go back to having a public input in public but yeah I just wanted to just thank the staff and also think rest I think you're ready left but you know if any anybody that doesn't know rest like you'll know he's a funny guy he's a lot of fun to us to be around and just just a great he's super smart and I've learned a lot from him so you know rest if you're still watching this thank you so much and I I gotta go to happy dog I've been actually craving it for a while so would have to swing by your food truck he needs to send us a schedule where he's where he is so we know how to find him yes hey if there aren't any more commissioner comments and we're gonna move on to staff announcements are there any staff announcements yes madam chairman thank you for the record Larry Nichols briefly I wanted just to cover a little bit about the what was just mentioned by Commissioner Guerrero about adjusting to the Coburn pandemic and the way we're able to conduct public meetings there has been some feedback about that and although it's not what we all hope for we would still want to be in the council chambers having the opportunity for people to step up to the podium and to voice their points of view on cases we have found that there is more participation people participating in viewing our these meetings not only the planet is owning Commission meeting but the City Council meetings that there was participation and coming to the City Hall for for those meetings so I guess that would be a positive I believe it to be a positive outcome on this we do think this we don't know what the governor will do in terms of really see spaces for people to to gather in such as the council chambers one of the proposals that's been considered is that we have a the capability of spacing the distancing at the dais for the commissioners and then to have the public to be able to gather in the city hall lobby and then when their opportunity for comment comes up they would step into the chambers and make their comments and that they they would leave we think something like that might enable us to begin to use the council chambers again and we're hopeful for that so we're going to be pursuing that with the with the City Commission they hope the governor will support it I believe the county is doing that mount so it maybe we can take a page out of their book on that one and then I guess the last item I have for the Commission is to make a brief coming about your upcoming workload we've all thought that with the pandemic that there would be a slowdown in development and slowdown in a subdivision proposals and reasonings and in variances and and all of this and we were fighting that it's not the case there's not a slowdown in fact the months of March April and May have exceeded the same time period of last year when there was no pandemic we're up about 18% in terms of activity that's double-digit folks then whatever something goes to double-digit I call that exponential growth and so we are experiencing that and you're going to be having more cases come up I think next month we have three cases on the agenda the next City Council agenda for their consideration [Music] and will be coming up at their next meeting that's going to be your work going forward to them for their review and I believe approval those are the main highlights I wanted to discuss with you but lastly thank you all one and all for a year continued participation and effort on having these meetings work and addressing the projects that are coming before you quite simply stated we couldn't do it without you so thank you madam chairman thank you if there are no further comments I entertain a motion to adjourn the adjourn is there a second then move the second that we adjourn all those in favor raise your hand thank you meetings adjourned it is 6:53
