[Music] you're on okay well good morning everybody welcome to our special City Council meeting today is Friday April 24th 2020 it's approximately 9:30 a.m. before we begin if you please join me the Pledge of Allegiance please sign them is going to be the conflict of interest they meant that swirl I asked if any member of City Council city manager any member of city staff has any known conflict of interest on any item on the agenda they see none now we have two resolutions first one two point one is item 2.1 is resolution number 2 0 - 1 4 7 no motion and second please move to approve mayor ok motion made by the council asked a second by Mayor Pro Tem under that and looks like they have a dollar hand we'll discuss a moral cancel this is Robert caballo with the City Attorney's Office and I'll be doing the presentation for this particular resolution which is for extending them the emergency may the mayor's emergency Proclamation first off can everybody see my presentation yes good so just to sort of recap on March 20 2009 Grisham lujan-grisham actually created a issued her executive order 20 2000 for which she declared a state of public health emergency to respond to the kovat pandemic on March 27th 2020 City Council passed the emergency the emergency declaration ordinance which allows the City Council and the mayor to exercise their powers through emergency powers through a proclamation on April 7th 2020 the mayor issued an emergency Proclamation and this was to potentially get a FEMA funds for reimbursement for our expenses to respond to the pandemic crisis whose also to allow the LCPD to be authorized them to enforce the quarantine or stay at home orders from the state now under us LC LC MC Section 938 be that that proclamation but what it ended in three days on a noon on April 10th City Council on the 10th of course extended that for another 14 days which ended on April 12 gonna end at noon today now as I said that proposed the resolution here today extends the emergency Proclamation again for additional 14 days to May 8 2020 under Section 93 938 see the extension runs concur with a new mexico mix of governor's executive order 2020 0 22 which extended the the public health declaration to April 30th the good thing about this proposed resolution there's an automatic extension built-in - which means that this Proclamation will be extended additional 14 days if for example the emergency statement the state's emergency orders are extended further and with that here your options and I'll open up the questions thanks Rob so basically nothing has changed from the last time we did this this is just merely extending it because the line that the length of the or life of the ordinance only has 14 days and so we need to do it again before it expires city at noon is that correct that's there is one additional thing the there's an automatic provision in there so where there's not an extension so now every 14 days we won't have to come back so this also ends though if whatever reason let's say the governor declares the declaration of emergency orders is ended here it's going to end on April 30 if there's not gonna be an extension or let's say there's a victor for whatever reason there's a determination it should end the governor ends at April 29th that you know it makes an automatic ending at that point gotcha okay okay let's see here we have councillor sword oh no let me get the David first they have a dollar you have a question no sir mr. mayor I just wanted to let you know that we received notice this morning that the governor's extended the executive order to meet 15 right gotcha okay thank you for that and yeah because I thought it was May 15th also but okay counselor sort and then councillor Vasquez okay mr. mayor um yes I also heard just last night in fact it was extended to the May 15th I'm sure we're all getting messages and and requests to change the order to open up more businesses I just want to make something very clear to all of us that about that particular request or that to picture particular action - do we even have the ability to change the governor's orders I don't believe so counselor okay thank you so just straightforward like that okay that's fine thank you so much a lot all over my hand yeah let me just before I get to cow service kissimmee r Pro Tem so the governor had a press conference on I think it was Wednesday and and her press conference was at 3 o'clock and at 2 o'clock she had invited the certain you know some too many mayors around the state to listen to her initial talk and in there and I notice the reason why when I'm talking is because I want to say this is because it's different than what was reported in the paper although today's paper Algernon got it really pretty good he was able to articulate what the governor had said because in our talk she had said that starting next week she's going to start really seeing certain businesses to open so that they're all open by May 15th okay not now not all excuse me let me clarify this so she said she's gonna start with things she specifically said flower shops and nurseries I remember those two and she said they're going to be more AG related and and she wants to do that the first week so that it doesn't over overload the system and then the next week they're gonna come up with a different industry she talked about pet groomers and she stopped right there and then and then that's where it stopped and so she did say the most problematic and the ones that's gonna be the most difficult are gonna be the bars and the nightclubs she said that so I just thought I'd share that with you with the counselor okay so we have councillor Vasquez and then Mayor Pro Tem Marin thank you so much for clearing that up that's important to me sure Thank You mayor thanks for asking that question counselor sword no we've gotten that request and I'm fully supportive of extending our local municipal resolution for an emergency declaration to run concurrent with the governor's Proclamation as well I just want to say you know message to constituents out there who may be watching is just that we're all in this together I know folks are getting impatient I know that there are certain counties and certain folks that are talking about acting hastily and in my opinion unwisely to reopen and you know I think yesterday we saw the biggest spike in cases recorded yet in New Mexico and so to me it it's a clear signal that we're not we're not even close to being to where we want to be however I am appreciative of having a plan in place to reopen one certain markers are met and so I have full trust and confidence in the in the governor and her staff who have done a tremendous job up to this point to really protect the majority of New Mexican communities and so just want to offer my support and also just to say that for myself and I know other members of the council we're all paying very close attention right to where where those markers are going to be at for us to start pushing to reopen but as of right now I just feel that it's just though still not safe so thank you mayor appreciate it and support this thanks counselor let me just say a couple more things before I get that Mayor Pro Tem I think you're gonna see that any business that does open their all the employees are gonna have to wear masks and gloves and I and I think they're probably gonna have to take the temperature before they go to work and if they have a fever of 100 or higher they're sent home and the customers that are walking in they may have to also have ppes as well so it's gonna be pretty strict but and I think there's probably gonna be of course a social distancing and there may be still be a limit as to how many people can congregate inside of a so I'm sure that with you as well Mayor Pro Tem Thank You mr. DeMaio for your presentation and to my fellow councillors in their questions and concerns Mary I appreciate I appreciate the the explanations given I am my comments and questions are going to be a lot of what comes from us gets to sort of alluded to and that is I know that our community is empty some people would use the word angst we've had a local business person want to do an event Friday and I was deeply concerned about that because I felt especially where the location is that they have quite a few higher numbers if you will of known cases and so I I guess I'm I'm concerned about I read in the paper about this group of business people that will be advising the governor and I want to know if there are advisors from the southwest side because I think that's important and and almost always if we're not jockeying into position this the southern part of the state gets lost in the translation just lost completely in terms of representation and I want for our business people to feel that they're heard and we have a very unique situation here and that we're a border community and so we are our neighbors are you know another state that was talking about opening up and and our neighboring country where lots of folks have family who go seek medical attention not only medical attention but medical supplies medications I'm deeply concerned about about that and so I'm not suggesting that up in the northern part that it's not any different it isn't but it is it is and so I feel very strongly that we I want to make sure that our business people are represented that they're heard that they're seen and I know that we are about I also am fearful that they're making decisions based on not having scientific um scientific evidence right or people to help inform them and so how do we do that I know that the first days that we went into session another special session we had Carrie Hamlin and that be more talk about a business group and maybe that's something that we need to consider here and ensuring that there is that that um representation that's going up to Santa Fe and specifically as it relates to the southern the southern communities or the southern counties my other concern marius is that we I think most of us have seen media attention that the Commission has received they are on Tuesday coin promote a resolution to open up the county how does that affect us because we are within the county so how do we work through that mr. Covey Oh bear yeah let me jump in real quick so thank you for those comments first off the economic recovery council is 15 people that the governor has put statewide and I think the one that's from southern New Mexico and they're to my knowledge only one in a Sally Stallman from Stallman farms now there's another one that she's going to do and what that council is meant to do is to is to reach out to various businesses to ask you know as I'm earlier when I mentioned about the face masks and gloves you know maybe taking of the temperature I think what the governor is going to ask these these 15 people issue me is to find out from their various businesses whether or not they'd be willing to do that I think that's one thing that she says she said and the second thing is she's gonna have a Council of Mayors around the state and they're going to suggest which businesses to try to open up first and so I think that that's where that's coming from the second thing as far as the county resolution really it's just really that it's just though it's something that if the county was to pass that it has no it has no teeth I'm sorry it's just meant to tell the governor hey we want to open up which I was asked to sign up I think that New Mexico Business Coalition had something similar a few days ago and you know I knew the governor was coming forward with this proposal to slowly open up businesses I mean it's not prudent to open up all businesses at one time and so to do is systematically like she's doing it is the way to do it so and I explained that to this group of Mayors another group of me I'm the there's there are subsections within these mayor's groups and there's some and understandably so in especially in the small communities they're literally dying that's they don't have the Walmarts they don't have the big-box stores like we have here so I hope that answers your questions on the county's resolution which is really more symbolic of anything and then what the economic recovery council is meant to do and let me just tell you something and I want to congratulate our colleagues here because when when we passed that 7,500 for Movida to reach out to these economic development experts they're good they're already starting to do what they would with a lot of these cities are trying to form and that is a group is how do we get bounce back and what businesses are going to bounce back and so you know when I don't know if you all are familiar who mark Lautman as mark Lautman was one of the one of the key players to start senator ASA back in the 90s early 90s late 80s and so he's a that these are some really smart economic development people who know of course that's that's our report so we're gonna get that information so I just thought I'd throw that out there I appreciate that mayor um I do I don't believe that the county even as a resolution speaks for me or the council and so I would strongly urge us them to if it is passed that there is some sort of counter resolution suggesting specifically to the governor that we believe wholeheartedly in terms of what she's trying to do I am a firm believer and listening to science and our medical committee who is struggling right now we have very blessed and grateful that our our our rates are the are what they are because we have tried very hard to follow our social distancing and and and then lastly mayor I I am concerned I appreciate that the governor is taking this stance and forming these groups but I've been a part of state government for many many years and I tell you what the people that get called in to speak on behalf of us in in a different community County the south it's very different and I'm glad and thrilled that the lady from the summit arms is getting to have her day and representing agriculture but it isn't all everybody and I especially am concerned about about ensuring that small businesses is at mom-and-pops you know our our Latino community is represented um specifically there at the table because it is very different all of us have small mom-and-pop shops in our communities are struggling especially our restaurant industry and I just want to make sure that we are capturing everybody's thoughts and concerns at one time and and again I I don't feel that one represented of 15 people is enough so thank you Mary hmm Thank You counselor a basis to be a counselor than Komal Thank You mayor I want to paint your time Congress for her comments a lot of my questions were very similar especially given our community representation at the state level I had a question regarding if this group decides that it's not a requirement that they don't want to have businesses to have the PPD and a face mask is that something that we can look at the city I think you know we're still edging up towards our our surge in our peak and though it can't protect you from everything it there has been evidence to show that people wearing the famous mash in public it is very helpful and so I'm not sure if that's something that we can look at what type of requirements we might have as a city to help protect especially given the fact that we do they're still seeing a lot of cases as well and now Pat oh and we know that we have a lot of connection with their community as well the question counselor beta Stevie I believe and I'll let the Jennifer Vega Brown or Rob coming I'll jump in but I believe that that if they don't require from a state level I think we can pass a ordinance that does require it you know I think our measures can be stricter more strict interstate does not mean good morning yes you're correct we can be more strict than the state great thanks thanks thank you as we see El Paso and what type of requirements they have but they're still seeing increased cases since we do have that interconnection we might be at a different place than in other communities so I would say moving for it that's something we should heavily consider and consider before we get into our surge in peak times just because we know that it could be very beneficial for our community thank you for that and before you get to councilman como let me next is councillor Bencomo Thank You mr. mayor I wholeheartedly agree with Mayor Pro Tem come on there were presentation on this I think if we were to agree to send a sort of parallel letter or communication to the governor supporting her supporting her orders sort of moving away from what the county of Dona Ana could potentially do on Tuesday perhaps we can add on there that you know we would like to see more representation from southern New Mexico Las Cruces I would actually also recommend though that there needs to be more representation on there beyond industry in business and perhaps nonprofits and people who have direct contact with workers in a different way than an employer it right it's about more than just the business it's also about protecting the health of workers and ensuring that there is there is just and fair relief that doesn't put people in danger and of course if people are suffering because they ours I think they're not gonna say no to going back to work but we have to ensure that their safety comes first for sure you know and if hospitals are struggling with PPE what why are we you know assuming that business is one right if hospitals are are missing some of these important equipment then why do we think we have enough for a bunch of other businesses so I think we need to just be careful I get the urgency I absolutely do in May I know you said you know that some rural communities are struggling I just want to point out though that economies are not dying the economies are struggling certainly and suffering but people are dying literally people are dying from covin 19:00 and we have to take that as priority before anything else you know this morning there was a New York Times article actually really lifting up the work that New Mexico has done and avoiding and avoiding higher suffering than a lot of other states especially our neighboring states given given our economic situation regardless being one of the first states in the country but they're really praising that we yielded impressive results against this virus and I think it's because the governor acted decisively and early and we can't deny that we can't deny those facts and I think we have to stay the course and it's funny because she also tweeted out or whoever tweeted out for her is doing a great job that the economy isn't suffering because stay at home orders the economy is suffering because of the virus and in order for us to reopen in the economy we have to beat the virus that is the only way and if we get ahead of ourselves I think we're going to be putting a lot of lives in danger and I think we're going to be putting a lot of our nurses and our health care workers in danger and putting pressure on our hospitals when when they won't be able to handle it anyway that that's it for me I really would if we are going to sort of encourage the governor to look at more people from down here I'd like for us to discuss not just business folks but perhaps nonprofit folks perhaps civil liberty civil liberties folks yeah Thank You mr. mayor and I fully support us exciting this of course okay well thank you coughs there's just a couple things thoughts on your comments yes okay it looks like we're gonna move forward with some type of resolution supporting the governor and and how she's systematically opening up business just keep in mind I think this economic recovery council was meant to focus more on business we can do it on nonprofit but that doesn't mean that you know you yourself if you'd like or if others want to join you I'll have your own subcommittee and do something here for the city of Las Cruces how to kind of put that together so they can kind of get an idea what you think are best practices regarding their health yeah I think it's my understanding that fantasy doing something like that so we wanted to look something up truth is I think it'd be worthwhile now as far as the mask when the governor was talking she didn't specifically say n95 mess which is what's typically used for the health care workers because those are hard to find I think she was talking about just even the real simple mask like when you would visit someone at the hospital that requires you to be I don't know if you were visiting one where they say you have to wear these plastics a gown and you have to wear these masks and real simple ones and I think those are still available and I think that's what she was talking about so I just thought I'd share that we okay we have Mayor Pro Tem you have a another question or comment mayor I do but I see that I'm comfortable onus once to speak she hasn't done so and I if that's okay I'd like to yield to her and I can come back if you're okay with that yeah sure you've got 15 minutes I'm just kidding counselor Flores go ahead I'm so glad you keep your sense of humor and I'm so glad that I feed it I'm happy to see all of you and I concur wholeheartedly a hundred percent with everything my colleagues have stated so far I and I really appreciate a kill serving como pointing out that it's the virus that is causing everything to close down not people staying home because they want to stay home and and yes it's very difficult and I think that I think everybody is now saying this is going to be worse than the the crash of 1929 so we are in horrible in a horrible situation and I know that my retirement accounts have gone down by about 20 percent so and then you know something I worked very hard for for once I was 17 years old so that's about 80 years ago so so it's very hard especially for someone in my age group to see that going that has gone down and and everybody you know it has a domino effect everybody's affected so all that being said I think what we know I don't I don't think I know that or my belief is that we have to keep people in mind above all we have to keep the health and safety of everyone at the top of the list and everything else is secondary I think that I know that based on what we were presented by the Department of Health last Friday that the CDC is going to come down here and look at what we're doing because we've been so successful in keeping our numbers down and when we look at the graph we can see that that were we're pretty damn pretty even-keeled in so far as how things are going but my big fear in addition to all the concerns and fears expressed by Councillor Bencomo American Gandara and and councillor Vedas to be is Texas has lifted a lot of they're a lot of their restrictions and and a lot of people from our you know southern part of Dona Ana County go to El Paso or there or they're shopping it's closer people from Anthony are on a drive here to go to Walmart they'll just drive to all pass out so hot I mean you cross the street and you're in the state of Texas there so so my concerns are really about the health and Jake get people I think we're all getting letters from people who are very very impatient I know we're getting calls at I know Miz got another was feeling a lot of calls from very angry people people are are leaving it quite frankly and but we can't but we as a council and really the you know we're here to put those interests of people first and foremost so I think that I think what we have to do and I totally agree with Jana with councilman Como about having other groups participate because even though even though we're looking at the economy and and the governor without the respect that they're looking at the AG portion or segment first well it's still people who are going to be working so we have to take those factors into account and we're going to be working who's going to be out there working people of course who have families to feed and and if they there think that as if there's a lot of people are disregarding as we all know in many states and perhaps here in our state who really don't believe it's necessary to take all this the all the precautions we've been taking so I feel very strongly mr. mayor since you're going to be part of that mayor's Council that you mentioned something about mayor's I don't I don't know if I will be I mean I have to be chosen well you better make sure you get chosen okay I have a feeling I might because we're we're down here yeah well we're southern New Mexico well texture I'll take the governor right I'll take Sir John said I hope you're a bond for you I'll tell her that counselor on for this is demanding that I be on the council well I think all of us mr. mayor I mean we're just like a largest city I'm not a feeling I will be but I just okay okay well and then maybe you can include our mayor pro-tem to be there I don't know I don't know what you know but it's just that we don't have enough and then with you know with the county coming forward at least one of the commissioners coming forward with this proposed resolution it really throws a big wrench into the beautiful work that we've been doing working so hard to keep people safe and healthy so I just wanted to express my concerns in that regard and my fears and and I hope that that economic council would economic whatever council does take into account that people have to be taken into account and we do need civil liberties and organizations we do need the 501c3 I mean the afl-cio is in there it's not really an agricultural economy agriculture organization and we make such a travesty the nail cannot have farm workers be part of their union and a pro Union you know my dad was a teamster but but in this situation I mean if you're gonna have the belt rail in there you know how do you feel you in there too you know half the once the trees have people heard they're the ones are going to be affected you know not not the owners of those corporations that's the people and those are the that's what we're concerned about Thank You mr. mayor did I use up my 15 minutes are you still got like 6 minutes left oh man all right so anyway I'm just kidding I'm kidding thank you mr. Ewing oh he went over so I'll catch it on the next time here for gem thank you for the laughs but no honestly I appreciate concert lettuces back and comments and concerns americ-aa I forgot to say how grateful I am to Movida you know there have an electronic version of a survey for specifically consumers sort of being that sort of it's being spread through a Facebook I don't know what other avenues and you don't know if counsel it's gotten a copy of that of that survey I'm very appreciative because it gives them not only as you know what to help with business but also from a consumer perspective what are you willing to do the only concern that I had with the survey is that it has a series of questions as a consumer what you feel like would need to be the things that in place in order for you to come into business if you will and you're only allowed to pick one option and honestly I was like oh I want to do this for this and another option you know as but you're not allowed to do that within the confines of the survey so I'm a bit concerned that it will and only I'll give a certain understanding about it and and so I had planned to reach out to Damon I'm today or over the weekend to sort of give my concerns about being able to select more than one but from my perspective I hate to be so being critical or constructive criticism during this time but I think he would benefit from it as as a group so Thank You mayor Thank You mayor pro-tem one thing to keep in mind I seem that he's done before like that for one one item only because what they do is they take the highest one and then of course there you're gonna have you know item a and that has so many votes an item beef and so they're still gonna do what you're asking but I think it's a little bit easier for them to compute quickly quicker so just thought I'd share that with a counselor her sword that was quick I just wanted to add my two cents worth here and and agree with everything everybody saw are you wearing that shirt for the draft tonight or what let's go yes absolutely absolutely to what we had to distract us from this stain at home Minnesota yes it is Minnesota yes no no no no not at all just testing him recommendations are for this and I trust the governor he's doing that and so I trust the governor when it she comes out with her orders so yeah I'm all in favor of following what is being done in the state I can see where smooth on small-town that isn't connected to much of the rest of the state I could have a little something different but that's up to them as far as I Thank You mayor okay thank let me see if I can share my screen with you guys never would see that yes okay great awesome mayor council Christine Rivera acting city clerk for the record um today I have a resolution to approve a public comment electronic public comment period during the regular City Council meeting so just a little background on March 23rd 2020 the New Mexico bowl New Mexico Department of Health issued a Public Health order stating that gathering of more than five individuals should be limited at that point that is when we started to have the zoom virtual meeting after that Attorney General issued guidance on complying with the Open Meetings Act and stated that members of the public should be afforded remote access via livestream or other similar technology if possible or a call-in number for listening to the meeting Robert's Rules of Order states that the chair must recognize any member or participant who seek to speak and he gives them the floor which is similar to what we do now during the regular City Council meetings so I looked at a couple of the other municipalities in our state to see what they were doing as far as their virtual meeting Sunland Park is allowing participants into their zoom meetings by calling or emailing the city clerk for the link and they're allowing up to 300 participants into their meetings Fort Sumner is having virtual meetings that they are taking comments via cell phone to the city clerk during the meeting well State Farm's is streaming their meetings on Facebook live so they're taking comments during the meeting also and then Alamogordo they have not had their first virtual meeting yet there we'll be the first week in May but they will be taking public comments emailed to the city clerk which will then be read during the public comment period of their meetings I also looked at what some of the cities around the nation are doing as far as virtual meeting and New York City and Clark County their schools were using zoom but they had to end up banning it because people were hijacking their online classrooms with racist and derogatory comment California one of their council meetings he's actually zoom bombed when a member of the public screen shared a pornographic image the Krait moon a Buddhist school district and Florida Keys School District are only taking comments via email which are then shared during their council meeting Gary Indiana their law does not require public comments so they don't even have those during regular City Council meetings and then in Woodinville Washington their comments are submitted by email and then read during the public comment portion of their reading so our recommendation is that if somebody has a can they meet their phone or looks like we're getting some interference err so the mayor and city clerk would receive public comment via email um I would suggest that all public comment be submitted by Monday morning that gives me a chance to print out anything that is submitted directly to me so that I can give it to the mayor once you receive these comments just like in any other regular City Council meeting he can limit the amount of comments that are brought forward all these comments should be read during the public participation portion of the City Council meeting and and they will be included in the minutes as well as the printed out versions of the emails will be filed away in our in my administrative file and we will be following the city manager policy on social media which instructs that no comment related to random or unintelligible comments would be allowed profane obscene violet pornographic language content that promotes or fosters discrimination on the basis of race color national origin religion ancestry fact age that to go on mindo mental handicap serious medical conditions also affiliation sexual orientation and gender identity no defamatory or personal attack no threat to any person or organization no comment in support of or opposition to any political campaigns no solicitation of commerce we no conduct and violation of any federal state or local law no encouragement of illegal activity no information that compromises the safety and security of the public and no content that violates legal ownership of interests so with that these are your counsel options we will need to amend the title of the resolution to take out the word policy um and I will stand for any questions Thank You Christine let me just jump in real quick before we go to Council so you know I thought about this and I know the the one problem with if we were to allow the public access to zoom and I think you saw many of the concerns that someone could could have access and they could do something unusual the second thing I was thinking is I would have no problem if well first off you you all probably still get emails regarding a particular item on the agenda because I I think you do I know I do from time to time so if you want to read those as comments when we're discussing a particular item on the agenda but what I wanted to share with you or tell you that I'm willing to do which is not that difficult to do I'm used to faulty tasking running meetings is they can email me during a particular item is there if there's a question that comes up as long as they identify it with the resolution number I'll take maybe up to five comments and and I'll be able to read it literally on the spot and you know unless it's a huge a novel just something that they may have some questions and I can respond to it that way I would I think that's a little bit quicker and a little bit closer to the public so that they can share with me or us their concerns which is not it's not hard for me to do really I mean I can I can read what questions they have and I can relay that to the council and and let that let it be answered that way in addition to what we're doing here is what I'm trying to say is I can I don't mind doing that and we're adding to it okay so with that let's see here who has question questions councillor FLOTUS you still you did you put your hand down or you have your hand up then we have counsel Vasquez Oregon como ganda Thank You mr. mayor and thank you miss Rivera for working on this so so I think what the mayor just stated right now is that it would it would be it would have to be modified you your presentation would have to be modified your proposal so I don't know I think that'd be kind of tough and I know that that's up to him but yeah and and councilor it doesn't have to be think formal I can still do it well you know with this resolution in play yeah I can just I can do that we can just we can if you want to move forward with what was presented which is fine and and but I want to relay to the public I'll take you know five five questions that they may have that they have to have the resolution if they don't have the resolution number I don't have time to keep looking through it because we got to get a lot of questions they have to have that resolution number if they don't have it I just I just have to move on Oh Thank You mr. mayor and so my question for Miss Nevada is how does this vary because I know that before we go to our media agenda items the mayor does allow people to make their public comments and and but we generally do not have questions for them and and so that's going to change isn't it because or do I have a poor recollection already of what our live meetings were like can you clarify that for me miss mr. betta how that would change if it would um Merrick come for photos I don't believe it would really change the only difference is that the person will not be publicly in front of you guys they'll be making their same comments like they would at a regular council meeting you just won't be able to ask the follow-up questions so that's really the only difference and if I don't know if Jennifer wants to jump in at all mm-hmm and how would this very then from Robert's Rules of Order which we generally follow and they're only you know that they're only suggestions really it isn't something that's something that we've incorporated as a legal way of proceeding that change it we actually do have where we're going to rely on Las Meninas or cold article 2 section 2 - 27e 1 which requires that the mayor recognize each speaker and we're also going to rely on article 2 section 227 F which requires that the the mayor may cut somebody short or allow adequate time so those are the things that are our rules do have inflation right now when something isn't specifically addressed we do rely on Robert's Rules of Order but and in general we ought you do have those rules in place that allow the mayor to do these things so actually it's an ordinance if it's in the music correct oh well that's good to know I didn't know that I thought that we just followed Robert's Rules of Order as as a guide so okay thank you very much mr. mayor mr. mayor and and the attorney may program Jennifer I don't suppose you can turn your can and I don't like really looking at that logo while you're talking so Larry that's okay oh and by the way Christine a little time yeah no I I think I think this is certainly a little bit of a challenge for us right because no matter I think no matter the circumstance we're gonna have to have things just be different operate differently right and and I'm willing to just the conversation or the questions we might be able to ask of a commenter I really don't see that happening there any particular way that we can devise in a way that's timely and efficient but I do want to be able to have the ability to receive comments during the meeting I think that's important because people may have reactions or ideas as specific councillors comment on a particular ordinance proposal and so I think it's important for us to have those come in in real time and so I don't know if there is an opportunity like we would during a regular council meeting to have all the councillors to be able to see the comments that are coming in and so maybe that's like there a new email address like council comments at las cruces dot org mayor which you would then recognize right you would you would select the emails or the comments that that you would like to read but if possible I would appreciate like counseling the the same you know seeing those emails come in in real time as well and then you could address those per the ordinance is that something that we might be able to do miss Vega Brown um mayor and council the problem with that is that it is the mayors and well the chairs prerogative to address they have to acknowledge every speaker so the chair has to acknowledge each speaker so if you're getting if you're receiving everyone's email the chair hasn't acknowledged that speaker and so that's why it that's why it is necessary for those emails should be filtered through the clerk and then the mayor because the mayor has to recognize okay okay I understand that's a I'm sorry to interrupt you as a matter of public record they are a public record sure you just wouldn't be okay sure that makes sense so maybe maybe getting then a list of all the comments that were submitted or something post meeting if that's a possibility but in real time the mayor would would select or they what those would be filtered directly through the mayor through the mayor's inbox I think I like that proposal and hopefully it works too mayor I you know for you don't get overwhelmed with too many comments during the meeting but it's certainly worth a try and I appreciate you bringing that up and so I think I think that's probably the way to go the at least for me I don't know what the limitations or technology is like in so far as you know Facebook and zoom comments in real-time unfortunately I have just seen how social media tends to bring out the worst in people the majority of the time it's kind of worse civil discourse goes to die and I would hate to see a negative you know a flood of negative comments or obscene comments or obscene photos come in without any way for us to filter them and then to have the public watching that right that stream of comments or that stream of unfiltered you know potentially offensive images and that kind of thing hey I just unfortunately see the potential for that happening right I think people people would do that especially if they have anonymous accounts or or that kind of thing and so so I think this might be the best way to do it I do just want to also ask a question about the speaker's identifying themselves you know I know that when folks come to City Council and identify their names in the districts it's something that's important to us right for that for us to know sometimes what district they come from not not not if they don't want to but how how do we how do we make sure these are real folks right because anyone can create a fake email address the fake name send some ludicrous comment out or you know put something out there that's not that they don't want to be held accountable for as a person and so I'm us a little bit worried about that right that people would would create fake email accounts because they don't want their comments traced back to them and a you know I don't know if we want to accept anonymous comments but I know in a regular City Council meeting we wouldn't we wouldn't do that right all right exactly so I mean it's just a matter of if they send it to me you know of course I'll I'll kind of read it and see if it sounds unbelievable but can't play by ear I wouldn't read too much into it I'm not too concerned with it okay is there a criteria then that we will ask folks to submit as part of the comment process you mentioned mayor you wanted to have at least the resolution or I think it'd be good just for them to mention what they're commenting on versus like the ordinance number the resolution number because that might be telling people oh yeah sure no they have to ask me the question on the email okay yeah okay all right well I think I think you know unless we have better suggestions or solutions I think that's support your proposal mayor Thank You mayor come services but we could also do is put some wording on the agenda that kind of guides people on what they need to submit Thank You Christine that'd be great and also if we announce through a press release that we will be accepting comments in this way would be great to get that information out that way and via actually a really incredible opportunity with even though that this is significantly harder and definitely a challenge for staff and for all of us um that you know Cova 19 has created and these virtual meetings um but I also think we have an opportunity to make government more accessible now for a lot more people and so I want to make sure that we consider that I think doesn't think that we could do something really incredible and um and you know I understand the fears of we all know what Facebook is like sometimes those comments and and so I get that I also have been part of through my work life I've been part of some Facebook live events where you know we have we were taking questions from people directly from Facebook and they were generally mostly very positive and people were very inquisitive um so I think it's I think it's a fair assumption to make that it could get nasty I also think we don't know we don't know what it could be like um and especially if um I don't know it could turn pretty badly I agree with you all I just also think that it could be a really big opportunity to make government more accessible for people um you know I think gosh asking them to mail to email things um I don't know it can get kind of tough sometimes right and not every and like email culture is very observer it's a very middle-class thing and so I'm just nervous that we're excluding we're continuing to exclude a certain population in our community by doing just that so um I no that doesn't I know I have no solutions and I hate to say that but I think that figuring out a way to field the actual questions and the actual positive comments on on and I'm only positive right because critique we can we can you could critique I think that's important from the members of the public but a way to feel legitimate comments from Facebook or YouTube I think I think is really important and I think that we could really change the way we provide these meanings to our constituencies so I really do want us to try that I don't know I don't know Christine or Jennifer if we end up saying like yes we're gonna try this and then ends up blowing up interfaces if we can then take it back but I I just feel strongly about that Thank You councillor Mayor Pro Tem Thank You mayor Thank You Christine and miss Jennifer Baker Brown and her legal staff I know a lot of work went into this so I very much appreciate everything that that you've done thus far this has been really important to me I've been having conversations with miss Vega Brown about the opportunities to seek commentary from our constituency via livestream because we do have that currently as our council meetings are live streamed and on Facebook and I had noticed and a couple of times and I had been out but look participating by phone and and then had the Facebook livestream that there are Tyson people comment but no one was sort of answering any of those things and any of the questions if questions have been brought up so I agree that it's important for us to receive commentary and questions during the meeting I think that's really important I hardly agree with concert angle most comments about an opportunity for more public participation I I think that really needs to happen and so I'm incredibly fascinated with Southern Park policy and the ability to have up to 300 people on June I think that's incredibly progressive and I I'd like to know any any more detail mystery that uh as it relates to that and how we have all here heard the crazy things that shouldn't has brought but I now know that they've changed a lot of or maybe beefed up security and so I am I'm interested I really feel that as I like that idea and that I want that us to really look at the zoom possibility having people participate as if they are at a meeting I think that this is incredibly important so I don't know Christine do you have any more detail about the Sunland Park model before you jump in Christine David did you have a comment you'd like to make yes plasticine my Estes interim city manager and this will hopefully this helps address both mayor pro-tem gondolas and contraband Como's questions and concerns yes I agree I think the entire nation entire world is finding out that we have additional opportunities for participation we have additional ways and potential to carry on our meetings with respect specifically to Southern Park Zoo I don't know that we have enough information on that to to answer that but I do know from our standpoint and allowing interactive participation during the meeting I think the mayor has as a good suggestion on allowing emails to take place even during the public participation item for those particular topics that come up specific resolution so that helps with that with respect to chat in facebook the way they do theirs or other social media Avenue that allows the chest to take place several concerns and couple of them have been brought up one of which was remarks type of remarks discriminatory offensive harassing type remarks we definitely want to make sure those don't come through and those chat rooms the comments come in so fast and so quick that it would be very difficult you have to have additional resources in place to try to spot those before they get there to have them deleted before somebody else can see them so we really put ourselves at a great risk for those opportunities what I would suggest I don't have a problem continuing to look at other ways that we can improve and have additional accommodations for public input but rather than just simply open it up I'd like to have staff see what potentials we have what resources we're going to need in place and run a few tests trials that way we make sure that we have it so that it works best for the entire community before we open it up this resolution here allows us at least a first phase of our increasing participation and it allows us to that people actively send information any questions in or comments in that can be addressed during the meeting as part of these discussions and then we can continue to work to our next phases in the future again depending on what resources we need and what parameters we can put in place to help us do that effectively and not put us at risk thank you and kind of along those lines David I think and I think a nice balance what mayor pro-tem found that I was talking about and what you've been talking about I think is as a suggestion that let's just say we have obviously if we have presenters or if members of the community are on the agenda of course they would be allowed access into zoom but I wonder and and David I know you're gonna check this in check this out is let's say we have we start off small ten or fifteen participants and then they have to get the credentials they have to email the city first we have to make sure that they're legitimate people you know that they're they have the right name they've got the right app email address and then one since they've been verified perhaps then they could be allowed the credentials that they could then speak it accounts with I don't know that's something I'm sure David and his staff are going to look at so I just thought I'd just share that with with you all mayor I I appreciate it and appreciate mr. mayor Steve's comments I think it's a nice balance I want to as the mayor pro-tem say that I I've been a part of facilitating some meetings and and and so getting questions and whatever is sort of balance when you get on that chat so I I just want to remind that in the event that I am facilitating that we what we have to be proactive and inform the public that I'd be the one that they'd have to email to as well and then I wonder about any questions that come in Spanish how how that how that would work because you know I know that we've been very clear with staff that we need our council may be bilingual and this like the idea of simultaneous translation and is something that we've been talking about for some time and so I I just want to bring that up I'm fine but I'm also interested in this the that idea of southern park it's it's a really interesting way that they have chosen to move through their meetings and so I'm happy to allow for the first step here is a good one I think that's an important first step and mayor to include I think it's important too for that to be included in the resolution if you're you're allowing the questions to be sent to you during the meeting I think that's really important that we have I have had several people on email me saying okay how are you working through this and we've heard that that's going to happen so there is interest for sure and being able to comment during during the meeting so I like for that to be included as well thanks Mir sure and and also Mayor Pro Tem I think my assistant staff we're going to look into some of the park if there and again we don't know if soon can be like there's 300 participants if that's all participants or if if there's a different mode where they can be view only and not participate and not be able to put any type of documents on the on the screen so there's a lot of different things I think staffs gonna and probably get bring to us by our next meeting okay we have a councillor Mascis I think is next and then for the beta Stevie and then Cole Thank You mayor yeah no I think councillor Bencomo brings up some really really good points and so I do I support everything she said and I think she's right we we have an opportunity to make local government more accessible and I think we should take it even beyond this limited time that we will have to be on zoom' meetings so I hardly agree with her and if it takes us a week or two to get there in order to get it right I support that support staff doing what they need to do to make sure that they they're confident in the type of tool that we're able to use you know I think councilman gum also brought up a good point about the accessibility piece and email culture middle class I think zoom more so than probably an email system would be even more limiting or out of the reach of kind of regular folks or average folks so social media probably is the most widely I guess use tool right for communication particularly Facebook and so I know with Facebook live you can I think moderate comments when people are posting things before they actually go live I believe there there can be a moderator function of someone that has to approve that comment from actually being posted publicly so it seems like that might be kind of the most widely available widely used platform just speaking from my own personal experience in terms of accessibility so so perhaps that might be an option that might be easier than zoom more accessible and then zoom or email but but again also share the concerns with that with just you know being able to make sure that we that we're getting you know respectful and comments that that other members of the public don't have to to endure you know any kind of profanity or that kind of thing because that that could break down quick so yeah I just wanted it to time back in with that say support this this recommendation or mayor with your proposal as it is but do also strongly believe that we should move in the direction of figuring out a way to use either social media or something that's that we're confident is very accessible to the majority of our constituents here thank you Mary okay thanks it looks like David myiasis has a comment David yes sir mayor David myiasis thank you or that or counselor Bosque I said again it goes back to what kind of councillors are brought up we we did look into the moderator the resources or what it takes per person to be have the ability to take out comments before they're sent to the chat and everybody else can see them one of difficulties with that as attorney Vega Brown pointed out according to robert's rules the chair is the one who decides what comments move forward or don't move forward and so we do run a risk if we have somebody differently who's deleting comments are taking them out before the main are seen them that we are making rules outside of that requirement so we're trying to figure out how we could meet that requirement but still have the ability to take those comments out before everybody sees them so there there are quite a few semantics and difficulties that take place we are trying to look into them we are trying to figure out again how we could move to a different phase but we do have to work through those thank you thank you David so before I get to councillor swords let me ask a drian something so Adrienne so during our meetings is there a way and I think you see this on telephones where they they flash a number is there a way you can flash my email address and say for public comment you know you want email Mary I've lost cruces org something like that is that I don't even know if you can talk I know you're the host but week yeah we could do that we could do that with a just like a lower third graphic like right now on the TV and YouTube you we have the date on the top left corner so we could put we could put somewhere on there an email address on the bottom or top or they can call train or and public participation is very important and I echo a lot of the comments that my colleagues have done one thing I am excited to learn more about the zoom if there is some sort of ability to sort of work with it so you can disable that screen sharing function for me even public and have more they raise their hands during allow that to happen during public comment and then if we could turn that shirt up off like we're doing presentations that there's a way to kind of work with the system that way I think it could be very useful to have people kind of be able to view in a different fashion I do feel that there are some concerns when it comes to sharing things on on Facebook there that area can be very good to include other people but it does turn into a very nasty place sometimes when there is no kind of accountability for who's posting and so that's something that I think we need to consider to just make sure these are a constituent these are people that are there to engage and and not just there to cause a disruption for just for the sake of chaos again and so if there's some ways that we can work with that but it can be it's something that we're going to have to monitor very closely on that but I I really appreciate Christine for you putting this together and for attorney Thank You counselor before you get the counselor I beat the I mean a counselor Bencomo so you all are going to look into in the future here is whether or not so let's just say you you all come up with the fact that we can do zoom they don't know they can't share a document and instead of talking they would just chat me something a question and then that way there I can decipher if it's you know if it's something that that is germane or something I can share with counsel then I could just read what they with the question that they asked me that's one thing that I was going to see if you knew off the top your head goes like right like I said right now I can looks like an only chat public record and if the rules that way there's no I'm giving Jennifer and finding better but there is a feature within zoom I mean one of the issue that zoom is it's what the regulars will wave the roots regularly set up you can't really distinguish who kid talk versus not it's all all or nothing but there is a feature called webinar where we can allow we can allow people to sign in register and then join they have no participation as far as being able to be seen or heard but they can use the chat feature or and you could also pull them so you can send polling questions and make it respond or they could use the chat feature so but they can never seem well that would be interesting when you all come up with your different ideas to share with Council the next week or two they'll be fine I I've learned thoughts about do I've learned that it's actually a lot more accessible than we think it is um you can download an app on your smart phone you can call in if you don't have a camera um there is also a really incredible interpretation tool so there is a way that you can have simultaneous interpretation so where the interpreter would only hear the speaker and me and the listener could choose the for example Spanish and I would only hear the interpreter I'd be able to see everything else I'd be able to see like for example the mayor's speaking but I would only hear the interpreter interpreting what that speakers saying so it's actually pretty incredible I like the webinar idea given that we only control what people might show us on your video I think that's a very important thing to recognize so I'll say that I haven't I have a question in terms of the like discrimination concern and like people saying discriminatory ugly things I mean what's our protocol when somebody says discriminatory ugly things in public comment in person well it all depends on if it's if it's pointed at me I just let them say it this point you guys that usually stop it or the staff I mean I'm being serious you know I have to be able to take any criticism or whatever they want to throw at me well sure I am NOT I'm not I'm accustomed to public criticism that I think we all are we would have gotten into this if that wasn't a thing that came with the job but my question is around I have been at council meetings as a private citizen and County Commission where people have said awful things about immigrants where people have said awful things about LGBTQ folks where people have said awful things about wage workers right so I think that there's also I hear the concern but that happened in person all the time also okay and so and that's good in fact how about if I form a select committee of one to help Adrian on zoom and its features would you be willing to join that I would love to help Adrian with that yes all right that way there you can share what other things that you've found and sure what's that they may already I don't know I'm curious to hear maybe from UM from or yes David my assess would just raise his hand or maybe even attorney make a brown or interim city clerk on this issue david myiasis you want to say yes mayor thank you david myiasis interim city manager you are correct counselor Bencomo you you do have the opportunity and our face to face and when we have the city council chamber is open to have somebody say something the difference there is the mayor pointed out he can stop them and it doesn't go any further again back to these chat environments and when people can comment and send in information instantly in millisecond you can have several comments come through and if we don't have the resources to be able to stop those before they get out then we're not able to deter that whereas in person you can you can stop what there's many people involved even if they say we find out the southern part does allow participation with 300 people you can have 300 comments in the span of 10 seconds come through and we won't be able to stop that with the resources we have right now so we need to vet out the process and how we can allow people to speak and know that they're speaking meeting Robert's Rules of Order but also being courteous and professional as we would ask anybody else is talking in front of Council thank you thank you David thank you I appreciate that I think yes I must I'm very happy to work with folks on on how do we figure this out because there's gotta be a way right and so I'm happy to do that and just before I get the mere pro-temp ganda just to let you all know how I choose who's talking here is whoever hits the race button first you go to the first align and so that's how it that's how it goes so just thought I'd share that with you I'm not that I you know randomly arbitrarily and capriciously that crews going to talk first I just started sure with you like this woof my little participant list here counselor Oh Jennifer you have something you'd like to say Jennifer Vega Brown yep yeah thank you one thing also that to keep in mind is the more filters you have the more people who are filtering through the information that gets to the mayor the more opportunities you have for special censorship and we don't want that we want see we want a few people to see it as possible so that that information can get to the mayor and then the Americans determine what's hurt like I said before the it's all a public record so in my I'm an attorney so I like things documented and so the written the written questions the written emails those are the easiest to manage because we can not only can we maintain them for the public record but we can make sure that nothing was changed in them and so there are many mechanisms now with technology to allow public comment but I think with art with what we have limited right now and our intention was to try this out see how it goes I keep adding to your rules of procedure which have not been finalized yet because it seems like every time they're finalized something else comes up but we'll continue to add to this I think will follow ephra if we're guidelines for when you submit a different request you have to provide a name and address so we can add those into the rules but again it's just going to be trial and error right now and we'll have adjust as we go okay great thank you for that Mayor Pro Tem take shelter thank you I appreciate mr. one for eight as amended I'm sorry beta Stevie yeah Tom survived oh yes come to Ben coma yes counselor yes counter Flores yeah counts are down that huh yes mayor yes okay now we're gonna go to a three point one Habitat for Humanity updates and I think either now the green or David Allen will be discussing primary this is Jan Lauterbach what the Community Development Department I believe I am tasked to discuss with that for Humanity update and I'll share my screen with you all all right can everybody see my screen yes okay I'm not sure if you all had any specific questions but I do have a PowerPoint I can present hold on lists all you're doing that councillor Habitat for Humanity has been operating here in las cruces their affordable homeownership program since 1987 since that time they have assisted 126 on households to become homeowners in Las Cruces the majority of their labor is through what they call caravanners mostly snowbirds it's a complex coordinated volunteer effort where reservations are made the caravanners choose to come to Las Cruces or wherever they want to go they make reservations and they can come to Las Cruces habitat fill a need for housing here in Las Cruces according to a recent survey conducted one in eight families in New Mexico spend over half of their income on housing cost spending and spending over 30% of their income on housing expenses leaves households cost burdened which provides for less money for food healthcare and other expenses the way habitat chooses their families they have a family selection committee they look at basically three things the need the ability to pay and willingness to partner with need their family selection committee assesses current household conditions whether it's the physical condition of the home overcrowding issues safety disabilities or excessive housing cost they also look at the households ability to pay similar to a bank underwriter looking at income credit history and debt to income ratios and then the households willingness to partner habitat does require sweat equity hours on between two hundred and fifty if you're a single parent household or five hundred for a married couple they can volunteer those sweat equity hours in either building their home other people's homes or in other capacities such as volunteering at the restore if they're unable to go out there or and swing a hammer they can volunteer at the restore or in other capacities with habitat they fund their builds a lot of funding comes from city home and CDBG sources and they also take advantage of our impact fee waiver program with the home funds we use home for direct construction cost hard and soft costs CDBG funding is typically used for land acquisition they also have a lot of proceeds from their restore that can be used to help with the construction cost at this time the restore has biggg has been deemed unassisted habitat also receives private grants and sponsorships from local banks and businesses for instance I know Wanda Bowman with Ashley Furniture can sometimes provide furniture Home Depot has provided plants for landscapes landscaping items like that and then other private grants and scholarships for their funding so what they've done in the past few years is habitat has worked in the Aurora subdivision they were given pretty good deals on Lots and in 2018-19 they completed five home each they are working to complete five homes here in 2020 and in the 2020 21 build season they're looking to build six homes the build season for Habitat in Las Cruces runs from October through April normally that's when the snowboards like to come down to New Mexico and build once it starts getting too hot they want to get out of here and go back to their homes in the Northeast and they also have volunteers such as like the 9-1-1 build day where they get emergency responders to come help them build and other organizations here in town to help build together making a big difference in the affordable housing in Las Cruces that is the end of my presentation and I will stand for questions thanks Jen let's see questions here so far no questions I guess Jan the O Telstra sort before I get to council circ so Jan I think that the biggest question was whether or not funds to help habitat or humanity should be coming from our tell shore fund or should or if so which other funds should they come through so that would be the main question and then I'll get the councillor sorry mayor just a quick question there on Jan where is the aurora subdivision what district or what part of the city oh we can't hear you we can't hear you - well Jan one thing microphones on Natalie the Aurora subdivision is off Elks Drive oh yeah thank you appreciate that Thank You Natalie mayor pro-tem antenna sorry um yes um thank you so much John for your presentation I was hoping that these updates would be about how they're dealing with the pandemic what sort of what sort of provisions have they made have they had to cut people as it relates to on the pandemic what are they doing with the funding currently how what steps have they taken like where are they at today those kinds of things do we have any of that information that you can share today mr. mayor mayor parte temp gun to the Natalie green for the record we are currently under development for the contract with habitat we need to get an agreement in place first before we can expend funding because these projects are built with federal funding they have to go through a procurement process so they will be working through that process to solicit local contractors to finish the houses they have under construction they have three staff members that are paid staff so they are working and implementing work from home and are taking steps to do that again dan mentioned that there restore is closed they can't open that right now so they've had a substantial loss of funding habitat holds all their own mortgages so they are providing mortgage relief to their existing clients who they hold mortgages for and I hope that answers most of your questions mr. million family Natalie oh sorry David I wanted to add one thing that Jan Natalie and I on state leadership from Community Development met with Candace Butler on the phone about a week and a half ago before last week's resolution Natalie made the point of that they hold their own mortgages so of the clients that they've assisted over the years that's one hundred and twenty-six I believe they're down into the 70s for people that still have outstanding mortgages to those with our discussions they had 12 people that needed mortgage assistance due to loss of employment one of the key things that and there are other avenues that habitat is providing them resources to and they're looking at a deferment the biggest impact from that loss of mortgage payments is it impacts the operations to Habitat as an organization those monthly mortgage payments while not big or large is what habitat keeps the operation open day in and day out along with the money they have coming in helps with escrow on insurance and taxes so those are key things your assistance last week as Natalie indicated we are working on an agreement because not because the money you provided last week but because of previous money from the city requires that federal procurement provisions both home and CDBG that's a key element so that's why it's taking a little bit longer but they're fully aware that and more than capable of implementing that for these projects this is a first for habitat because they've lost the caravanners due to travel restrictions and it's in our best interest and there's not to have people traveling to the community there may be follow-up by city staff with kandace if there's continued or extended need for other mortgage assistance opportunities and we feel like the best way to do that is regardless of the city's source or the project whether it's tell Shore or general fund getting back to the mayor's sorry the senile old cap the getting the back to a situation where we transfer the money to the affordable housing fund and then we can record that appropriately so that's all I had man you can't take housing from tell Shore or the general fund we we generally think the Telstra fund for more emergency housing like sheltering or serving the homeless or victims of domestic violence in relatively short order sure either's appropriate appreciate that you know when I'm hearing the updates it's just kind of getting from my perspective where these agencies are at what are their the positives and negatives you know where where are they at with the funding you know those kinds of things so if I hear you correctly the funding that we provided last week it has to go through a procurement process because of the federal guidelines yes mayor mayor pro-tem not for us we can execute that agreement with habitat on its own habitats end to use the money for construction they have to go through procurement because of our other contributions from federal funding sources god okay Thank You mayor thank you everybody okay so let's go to the next update and that is the micro loan program and I believe dr. Griselda Martinez discuss or present yes good morning technology it's great when he works right I'm gonna share my stream here all right good morning mayor and city council my name is crystal de Martinez economic development director I'm here to update you on the emergency assistance micro loan program that do you have approved in the last two weeks through two different sources and I'm going to just summarize the history of the funding sources on April 10th as part of the resolution allocating 1 million dollars for assistance through the tail Shore funds we receive seventy four thousand five hundred dollars for the technical assistance program during the discussion in City Council in the use of the Telstra fund it was recommended that a different funding source should be funding this program although it is related to coverage city manager's office felt that it was more appropriate to utilize the different funding source so we went back to City Council on April 17 where the funding source was changed from tariffs on to general fund and that's where the funding source is right now and how we're planning to move forward to fully fund this program a little bit of background on on this program as I mentioned before this program is really tailored to alleviate some of the challenges that small businesses are facing and if a double-double effort one is a technical assistance that can be provided to them by talking to them by connecting them to resources and also to make sure that they are prepared to receive loans shall they need it and that they are eligible to to be to pay in full so we had already identified a financial gap in our community for small businesses who already faced challenges in accessing resources and with this current situation we decided to move forward with a quick with a smaller amount to be able to meet the needs of the emergency so right now following our recruitment process we're evaluating the quotes and we're defining a contract for six months I want to make sure that it's clear that these services are above and beyond what this partner agency would have been doing otherwise the partner agency is is define as a community development financial institution and certified CDFI s-- are in nature by it by their mission as a certified entity serving low and medium income communities including businesses so in their mission its imprint for them to align what we're looking for and what they're ready to find to do so they there are part of their mission is to bring economic opportunities to low-income communities and providing access to financial products for residents and businesses so the business performance measurements that we are aligning in our contract as a line with other performance contracts that we have in place with other service providers we are really focusing on technical assistance which will include one-on-one visits between the CDFI staff and businesses other consultation forms such as information sharing as well as educational workshops we believe strongly that businesses struggle to connect to resources and so this would be another forum to connect resources to the needs of the business owners one key component here is once a business it's strongly positioned with all the knowledge that they have to have to be able to be ready to request a loan that they remain in business not just for the repayment of the loan but for for next steps after that another key component to CDFI s-- is that they they provide loans to the traditionally non bankable businesses so the goal would be for businesses to be strong enough to transition eventually to a bank a more traditional bank and another item here is that we are looking at the conversion rate of the technical assistance that this CDF I partner would do and then how that translate into actual loans which would mean more capital acts that businesses have access to another big element here is that traditional banks do not usually Lin amounts less and $100,000 and through these technical assistance we would be looking at loans much smaller than that to go from two thousand all the way to fifty thousand so as per the discussion from last week we are revising we have revised the contract to include reporting of demographics the type of businesses and in two key elements that I want to highlight is that this small businesses in our community are the ones providing jobs to community members so for us to focus on the number of jobs as a as a key component to providing opportunities for our committee members it's important and also how much average sales the businesses have because that translates into a metric of success success for our community success for businesses and success for for people job seekers looking for opportunities also as I mentioned the the transition between technical assistance and actual loans it's important and so we'll be monitoring closely these items as well as utilizing this this technical assistance as say as councillor Stewart mentioned last week as in economic gardening strategy - for business retention in our expansions and and to translate into business I mean jobs routine so with I open it up for discussions and like I said we are in the review process of the contract and we will keep you posted as soon as this contract is in place we are planning to promote it through our email blasts once the service are available and also we're we're working with our partners including the Chamber's movida Arrowhead Center small business development centers for them to help us promote this opportunity and make information available for small business owners in our community thank you dr. Martinez looks like a counselor sort has a comment and counselor photos I thank you mr. mayor and thank you dr. Martinez that yes this is sounds very interesting I am little confused on this whole thing I was wondering if this is this a result of the probit 19 epidemic or assist something completely different unrelated this was a result of the Hobart 19 I think one of the counselors either Mayor Pro Tem or Kelso Vasquez or become one of them asked to have this put on and I was looking at it have us donate that money I thought this is a good program long time ago and and I did I'm wondering it just is the epidemic just the emphasis to get this going now more than ever and if so how does it relate to the federal grants and loans that are being given to small businesses well I think if I if I made dr. Martinez two things real quick chanceless org I think this really matches well with that Movida study that we're going to be seen because I think you're gonna see they're probably going to come back not only on ways up this is the starting up if they do start up but you're also going to see an emphasis now on on PPEs and ways to keep residents and the public safe from you know like disinfectants so this I think is going to mirror real well and to to help those businesses that are even looking at starting the business and this might be one of the focuses that be sort of things so yeah so in other words this is just for supplies and efforts for the it's it's a loan just it's a small loan to start you know maybe it's so it's not a grant so it's it's a loan to various businesses that want to start up and and there could be a lot of home-based businesses that that need some type of money to begin with products with supplies you know maybe they're gonna start selling mass maybe they're gonna start selling gloves I don't know but that's why I said I think it's gonna bode well with our study that we're gonna hear from Evita down the road and then I assist was going to say that other program that the federal government has counselor is for a lot of it are existing businesses that already have employees going on PPP that's for current employees are current businesses that have employees that they don't want to have them go on the the unemployment magnet they're paying them still and then their other one that the government has the economic economic development or economic injury I forgot the name alone but that's more of a long-term loan anyways that means that dr. Garcia I mean dr. Martinez discussed some thank you mayor mayor Councillor honest org I appreciate your interest in your questions this is another in we had identified a gap in access to financial resources to small businesses however in light of covet this became a crucial need we have as you may have received communication by businesses business owners are struggling more than ever and this is just during the the current situation we expect a very hard situation after even after we opened the economy and we need to connect resources to businesses and and for them to stay afloat and remain in business it is important for business owners to get connected to resources when all these federal programs and state programs became available business owners were overwhelmed with information and the processes are often very complicated and so part of the process of this technical assistance is to connect the resources and to help business owners navigate the the existent opportunities for federal or state programs and so our partner who would be expected to be knowledgeable of all the different loans available and to help them connect to to those resources additionally CDFIs have been made eligible to receive funding from the federal government that can be allocated to those businesses that they're working with and so it's not only the funding that they already had or or funding that available previously but additional funding that has become available for this given this current situation and so it's continuing to connect the resources and helping small business owners who may be overwhelmed with the current situation and with the amount of information to navigate the system and get the adequate assistance that they need these loans then are to help small businesses I get to help them get federal loans and grants under the care exact another legislation that's being passed by the federal government I don't understand it that's that's one aspect counselor historic another aspect you see the Community Development financial institutions already have funds because that's part of what some of these CDFI s-- already do and so it can be a two-fold access to to financial capital the one available through the did I lose you know already available through their funding resources plus the additional funding available made available through this current situation have you had inquiries about this kind of help from businesses counselors sort gifts actually this week we have we had two inquiries from business owners trying to find resources and trying to find either loans or grants that can support them through this very difficult times and as we continue to work with decision sending our eblasts communications we expect this to to become more prevalent another item that I want to bring awareness is that we are available in case any business is looking to connect to resources i want to make available the email address that we have for businesses to connect with us its econ dev ec o n de b at last Cruces org and so as I mentioned last week if you have anyone looking for support assistance or resources please refer them to us where we're going and it's going to be very important to continue to support our business owners you know community yeah I send that to me in an email please I'll spread the word so until a little confused here so they these businesses need this startup money a few thousand dollars in order just to apply for a federal loan just so you know this can be this funding can be utilized for them for whatever restrictions the financial institution may have but for the most part funding that they access to through these loans can be used for operations okay it's not it's it can be startup capital but it can be to remain in operation or to expand in the current situation I would not see expansions as the number one item although some businesses are growing but majority of businesses are struggling to stay in in business and so I would see majority of these loans going to to keeping the business in operation okay thank you very much again I this is something that I've been thinking about her been talking to say for example Terra del Sol was interested in just a similar kind of a thing and I'm I was hoping we would have done it a long time ago on but anyway yes the economic gardening you mentioned is what this is all about - on that technical assistance is really important so in the end when the money's all used up come back to us and say how well the program went okay yes sir our plan is to keep monitoring the results very closely and as we discussed last Friday we want to make sure that we continue to address the needs as we see them in our community great thank you very much thank you man so before you pick alistair florida sai counselor sword let me just share something with you that we may want to consider thinking about so obviously there's a lot of restaurants now that are one who's really capitalizing that's doing really well every time I Drive up Lomond is chick-fil-a I mean they have a double drive-through right and so when you stop think about it some of the restaurants that are going to have challenges are those without a drive-thru window and and I wonder if maybe we need to look at possibly being able to help those businesses maybe even through some type of a microloan I don't know but if that's something that we might want to consider I'll share with you something that that true story so my first job was at Taco Bell okay when I was fifteen and a half right here just right down the street it didn't have a drive-through and and and then they decided to put the drive-through in and business increased 30% I mean this is like 1978 that's how and so drive-through really you know helps I mean people want to get out of the car and they want to get the food and so what better way is to maybe look at some of these businesses that if we were to relax some rules and maybe help with drive-through modifications on the restaurants because if not you're gonna see the the ones with the Drive thrus I mean I I see CSUN or Express they're so busy they're one lane on the moment is is blocked you know so these are things that that that has stuck for so the let's say Martinez was saying that there's some that are really frightening and and some that aren't and then the ones that are thriving the ones with the drive-through windows mayor I would be okay with that if it was a local business the fact owned by local people here but not for a national chain I would disagree with helping financially with the national chain sure no I understand and just just the FYI sometimes those national chains counselor are are owned by local business owners because they're just franchises but there are company stores and then those franchise stores there's a slight share the distinction counselor Florida's you are next and then come for a baby Thank You mr. mayor and thank you dr. Martinez but your wonderful work I've always felt that the city is quite fortunate to have you too have you and our economic development director so thank you so much for doing this work I think that it's our small businesses and I agree with counselors board I would like to have the local businesses helped out more I think they would be prioritizing my mind I don't know what your guidelines would be but so my question is so the status right now is that this contract that you're looking at to provide you with a bunch move forward on this is in process is that what I'm interested or mayor mayor Councillor of Florida the funds were allocated through the resolution that was that you all approved last week we working through our recruitment process we have drafted the contract and it's under review by legal and purchasing so we expect similar to what Natalie green presented earlier we expect this contract to be in place before we can actually start the services with our partner so once the procurement process is finalized is that when you're going to send out an email blast to make small business owners now informed about this and how how soon do you think that will be yes ma'am mayor Councillor FLOTUS we have been communicating with businesses through through since since they started and this will be blasted out as an additional resource made available for them we will be working closely with legal and purchasing to expedite this contract so we will keep you posted as soon as this is approved and finalized but we will we will make a big outreach to our community to make sure that people are aware of this opportunity do you have a timeline or any time how long it would take I'm just wondering I would I would think our small businesses are drowning correct us are hurting correct I would I wouldn't want yes ma'am we we are working through this as quickly as possible and I agree with you the this is time is of the essence so we we're emphasizing that as we work through our process so thank you very much yes ma'am thank you very much dr. Martinez Thank You mr. mayor Thank You councillor bait the Stevie you know and thank you dr. Martinez I'm curious to see what guidance will come out from the state level on what industries they expect to be kind of phased back in and I think that's going to be important for us to look at I worked at a restaurant and time I was 16 till what 23 so I am very well aware of that type of industry and I think they've been able to adapt fairly decently in comparison to a lot of other industries you know most are still able to find a way to continue on having their doors operated and open I'm very concerned about some industries that can't open it all right now they have no other function if we take even like ones that have high levels of personal contact like our lung and a lot of them are female own as well and we know that they're that high level of contact I would expect for them to be in the first or second fact to be open so looking at ways that we can maybe even target those industries that are going to be last nonetheless to offer assistance I think might be something to consider thank you for that recommendation counselor I've a chance to V we will we will consider further what sectors those may be but you you have a really important point that some may be struggling more than others yeah and like I said I I think some businesses have been able to adapt very well and not I mean yeah I've been really inspired by the creativity and what people can do but like I said there's some that - they can't be open at all in any fashion right now and and that's going to be hard and it it looks like those are also industries that probably can't be open for a while thank you well thank you dr. Martinez I think that concludes our updates on the various two programs that we were discussing last week so before we close I just have a couple things I'd like to ask Council so if we were to go to the next Friday that would be May first and I was just wondering if you wanted to you know the Monday is May 4th so the couple of items that we may need to discuss only on Friday if you want to move it to two may May 4th which would be Monday and then skip next Friday May 1st meeting so that's the first thing I want to ask your good was May 4th I'm ok with May 4th mr. mayor is there anything that we need like constant follow-up or reporting on some of the funds that are have been some some of the funds that we've allocated any developments but oh we can have that on the May 4th meeting and as part of our council meeting sure of course being agenda item well nup date just a discussion just to give you numbers and for normally for council but for the public as a whole and then because the main thing the reason why we had to have today's meeting was to extend that resolution and so by Nick by by May 4th we won't it won't you know we could probably have another one we may have to have another one that following Friday to extend the oh no that's I take that back ours is good until the governor's declaration nevermind forget that okay okay the second thing is I'm thinking of putting on that council agenda is a moratorium on you TVs so just thought I'd share that with you because they're there we're getting too many complaints you know initially I thought these you TVs we're just gonna be on the weekends driving on some small streets to get to to ride in the desert but they're just all there just seem to be all over the place and then the most important thing is or the bad thing about it is ATVs are on the street now yeah I don't know if they think that this is just a you know free-for-all but I'm not asking for any comment of you all but I just didn't want you to be surprised whether you choose to support the moratorium you know that's that's councils prerogative I just thought I'd share with you that that's gonna provide I've asked legal to at least draw that up and the moratorium would be at least 30 days 60 days until we get through this endemic because right now you know a lot of people were home and a lot of these drivers are you know have their buffers off and which are not supposed to and we don't need our Police Department necessarily trying to stop the name of other things I got to deal with and they have to deal with with you know loud and car or vehicles and things of this nature that shouldn't be so this is our way of helping to contribute to at least keep this under control that might be the way to go I just thought I'd share that with you all okay if there's nothing further entertain a motion to adjourn okay tell me one second a motion made by councillor Flores and second by councilor story that we adjourned all those in favor signify by saying aye aye those opposed yeah we're adjourned it's 1144 a.m. and councillor florida so the governor texted back and she said she says mr. mayor thank you for your interest I'm working with John Bingham in the group now and we were sure interest with Mighty they say and give my regards to Yvonne so just kidding but she didn't say that though I mean she okay so all right we're adjourned we'll see you guys have a good weekend
